Big Quote

In many countrys all over the world quoting is subject of the legal concept of “fair dealing” or “fair use”.

That differs a lot from the german system.

In Germany Quoting  is subject of § 51 UrhG and § 63 UrhG

Article 51 UrhG is dealing with quotations in the following way:

It shall be permissible to reproduce, distribute and communicate to the public a published work for the purpose of quotation so far as such exploitation is justified to that extent by the particular purpose.

This shall be permissible in particular where

1.  subsequent to publication individual works are included in an independent scientific work for the purpose of explaining the Contents,

2.  subsequent to publication passages from a work are quoted in an independent work of language,

3.  individual passages from a released musical work are quoted in an independent musical work.

The attentive reader will already have noticed, that there is a significant difference between alternativ 1 on the one hand and altenatives 2 & 3 on the other hand side:

In alternative 1 not only passages are permissible but the hole work can be included. This is the so called “Großzitat” wich I chose to translate with “Big Quote” in the headline of this blog-entry.
